Terms in plain English

Our terms in plain English

For the buyer who has decided and is now looking for the catch. Each line below is one term, taken from our pricing page or our terms and conditions; the two lines on where data is held and on this website are from our security page. Nothing here comes from anywhere else.

Money

The price
The prices on the pricing page are our list prices: the platform at £150 a month plus VAT, each module at £150 a month plus VAT, and setup from £599 plus VAT per site.
What is not charged
There is no charge per visitor or per user, no separate support contract, and no charge for version upgrades.
Setup fee
The setup fee is invoiced when you sign and is payable on receipt, by bank transfer.
Monthly fee
The monthly subscription is collected by Direct Debit from the service commencement date, whether or not installation has happened by then.
Price changes
The price does not change during your first twelve months; after that it can change on thirty days’ written notice, and if you do not accept the new price you can give notice and leave.
Late payment
If payment stops or the Direct Debit is cancelled, we can remotely lock the hardware and suspend the software until the account is brought up to date, and the agreement carries on.

How long, and how to leave

Evaluation
There is a fourteen day evaluation period from signing in which you can walk away without penalty.
Minimum term
The minimum term is twelve months from the day the service starts, and after that it rolls monthly.
Notice
Once it is rolling monthly, you leave by giving thirty days’ notice.
Leaving
You can export your records from the dashboard at any time, and the hardware comes back to us within fourteen days of the end, or it is invoiced at full replacement cost.
If we stop
If we ever discontinue the service we give at least ninety days’ written notice, keep it running and supported throughout, export your records free as often as you ask, and let you end the agreement at any point in that period with a pro rata refund.
Businesses only
We contract with businesses, so the consumer cancellation rights do not apply.

The hardware

Who owns the hardware
The iPad, the stand and, with the badge module, the label printer stay the property of Noon Elite Ltd, so there is nothing for you to buy, depreciate or dispose of.
If it fails
If a unit fails we ship a configured replacement in three to five working days at no cost.
If it is broken
Accidental damage, such as a cracked screen, is charged at the actual cost of repair or replacement, and loss, theft or deliberate damage at the full replacement cost.
Consumables
Badge stock, lanyards and wallets are yours once delivered, and you buy more when the quantity in your setup fee runs out.
Early access modules
A module marked early access gets the same support, and it is for you to satisfy yourself it suits your process before you rely on it.

Data, support and liability

Evidence, not compliance
The kiosk produces evidence; we do not warrant that using it makes you compliant with any standard, and we are not assessors, auditors or advisers.
Your data
You are the data controller and we are your processor, and the Data Processing Agreement governs on any question of personal data.
Where it is held
Kiosk data is held in the European Union, in Ireland, with one exception for the Permit to Work module’s email, which the security page sets out.
Uptime and support
We target 99.9% software uptime and aim to answer support requests within 24 hours during UK business hours.
Liability
Our total liability is capped at what you paid us for the service in the twelve months before a claim, except where the law does not allow a cap, and data protection has its own cap in the Data Processing Agreement.
This website
noonelite.com sets no analytics, advertising or profiling cookies, and has no tag manager and no chat widget.

This page is a summary, and it does not change any agreement. In the words of our terms: “Where you have signed an agreement with us, that agreement prevails over these Terms to the extent of any inconsistency.” On any question of personal data, the Data Processing Agreement governs.
